Georgia Apportionment Statute in Single Defendant Cases

We handle cases throughout Tennessee and Georgia. Today, a very important decision was published by the Georgia Supreme Court. In Alston & Bird, LLP v. Hatcher Management Holdings, LLC, the Court granted a writ of certiorari to determine, in part, the following: “When an action involves a single defendant, does OCGA 51-12-33 allow a reduction of damages against that defendant in accordance with the jury’s allocation of fault to a nonparty?” The Court held: “We affirm the Court of Appeals’ conclusion that apportionment under OCGA 51-12-33(b) does not apply to tort actions brought against a single defendant.”
